1. Introduction and Scope

1.1 These terms and conditions govern your access to and use of the Turaco Collection website at www.turacocollection.com and any related webpages operated under the Turaco Collection name (the Site).

1.2 The Site is operated by Turaco Hotels Corporation, trading as Turaco Collection. The hotels featured on the Site are owned or operated by separate companies in Tanzania. References in these Terms to Turaco Collection, we, us or our mean Turaco Hotels Corporation and, where the context relates to a particular hotel, reservation or service, the company that owns or operates the relevant hotel.

1.3 The identity of the relevant hotel and, where appropriate, its operating company will be shown in your booking documentation or made available to you upon request.

1.4 By accessing or using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Site.

1.5 These Terms relate primarily to use of the Site. Reservations, accommodation, dining, spa services, transfers, safaris, excursions, activities and other services may be subject to separate booking conditions, waivers, policies or terms presented at the time of booking or by the relevant hotel or service provider.

2. Other Terms That May Apply

2.1 Our Privacy Policy explains how personal information is collected, used, stored and shared when you visit the Site, make an enquiry or reservation, stay at a hotel or otherwise interact with Turaco Collection or a relevant hotel company.

2.2 Our Cookie Policy or cookie-management notice, where applicable, explains how cookies and similar technologies are used on the Site.

2.3 If you make a reservation through an independent booking platform, hotel brand, loyalty programme or reservation system, that provider’s terms, conditions and privacy policy may also apply.

3. Access to and Use of the Site

3.1 Access to the Site is provided on a temporary and as-available basis. We may suspend, withdraw, discontinue, restrict or change all or any part of the Site without notice where reasonably necessary for operational, security, maintenance, legal or business reasons.

3.2 We do not guarantee that the Site or any Content will always be available, uninterrupted or free from errors.

3.3 You are responsible for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

3.4 We may restrict, suspend or terminate your access to the Site if you breach these Terms, misuse the Site or create a security or legal risk.

4. Intellectual Property Rights

4.1 All text, photographs, videos, graphics, logos, trade names, trademarks, designs, software, layout and other material displayed on or made available through the Site (Content) are owned by or licensed to Turaco Hotels Corporation, the relevant hotel company or another rights holder and are protected by applicable intellectual-property laws.

4.2 You may view and download extracts from the Site for personal, non-commercial use only. You must not reproduce, modify, distribute, republish, transmit, display, sell, license, create derivative works from or otherwise commercially exploit any Content without prior written permission from the relevant rights holder.

4.3 Turaco Collection names, logos and related marks are trademarks or trade names of Turaco Hotels Corporation or the relevant owner. Third-party hotel brands, loyalty programmes, company names, product names and logos appearing on the Site remain the property of their respective owners. No licence to use any trademark is granted by access to the Site.

4.4 If you print, copy or download Content in breach of these Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies made.

5. Information, Images, Rates and Availability

5.1 Information displayed on the Site regarding our hotels and resorts, accommodation, restaurants and bars, facilities, amenities, wellness services, activities, excursions, transfers, safaris and other experiences is provided for general information and may be subject to change.

5.2 Photographs, videos, floor plans, illustrations and other visual materials are intended to provide a general representation of the relevant property, accommodation, facility or experience. Individual rooms, suites and other spaces may vary in size, layout, furnishings, decor, outlook, views and other features.

5.3 Certain facilities, services, activities and experiences may be seasonal, weather-dependent or subject to availability, operational requirements, maintenance, government or park regulations, safety considerations or other circumstances beyond our reasonable control.

5.4 Rates, packages, promotions and offers displayed on the Site are subject to availability and may be subject to additional terms and conditions, including applicable taxes, fees, minimum-stay requirements, booking periods, travel periods, blackout dates, deposit requirements and cancellation conditions.

5.5 Unless expressly stated otherwise, displaying accommodation, a rate, package, promotion or experience on the Site does not guarantee its availability for any particular date.

5.6 Errors and Omissions. We reserve the right to correct errors or omissions in information displayed on the Site, including obvious errors in rates, descriptions, availability or promotional information. Where an error affects a reservation you have already made, the relevant hotel or booking provider will contact you as soon as reasonably practicable and deal with the reservation in accordance with applicable law and the booking terms applicable to it.

6. Reservations, Bookings and Payments

6.1 The Turaco Collection website does not process reservations or online payments directly. If you choose to make a reservation, you will be redirected to an independent booking or reservation platform.

6.2 Your use of the booking platform, reservation made through it and payment made to it will be governed by the terms, booking conditions, cancellation policy and privacy policy presented by that provider and, where applicable, the terms of the relevant hotel company.

6.3 Different hotels, accommodation types, packages, promotional rates and travel dates may have different deposit, payment, amendment, cancellation, refund and no-show conditions. You should review the applicable conditions carefully before confirming a reservation.

6.4 The independent booking platform may collect and process payment-card details and other payment information under its own terms and privacy policy. The Site does not receive or retain your complete payment-card number or card security code.

6.5 Turaco Collection and the company operating the relevant hotel may receive reservation and transaction information needed to manage your booking, including your name, contact details, booking information, payment or deposit status, transaction reference and refund status.

6.6 Where payment is made directly to a hotel, including at the property or through a payment link issued by the hotel, the relevant hotel company and its authorised payment provider will process that payment under the terms and privacy information applicable to the transaction.

6.7 Certain hotels may participate in or operate in association with third-party hotel brands, loyalty programmes or reservation systems. Participation in such programmes and reservations made through their systems may be subject to the separate terms and conditions of the relevant provider.

7. Links to Third Party Websites

7.1 The Site may contain links to booking platforms, hotel-brand websites, social media platforms and other online services operated by third parties.

7.2 Such links are provided for convenience and information only and, unless expressly stated otherwise, should not be interpreted as an endorsement by Turaco Collection of the relevant third party, its website, products, services or content.

7.3 We do not control third-party websites and do not guarantee the accuracy, completeness, availability, security or reliability of information or content appearing on them.

7.4 Your use of third-party websites and services is subject to the terms, conditions and privacy policies of the relevant third party.

7.5 To the extent permitted by applicable law, Turaco Hotels Corporation and the relevant hotel companies are not responsible for loss or damage arising solely from your independent use of a third-party website that they do not operate or control.

8. Acceptable Use

8.1 You may use the Site only for lawful purposes.

8.2 You must not:

• use the Site in any way that breaches applicable local, national or international law or regulation;
• use any part of the Site or its Content for unauthorised commercial purposes;
• reproduce, distribute or otherwise use copyrighted material, trademarks or other proprietary information without the permission of the relevant rights holder;
• knowingly introduce viruses, trojans, worms, logic bombs, malicious code or other technologically harmful material;
• attempt to gain unauthorised access to the Site, the server on which it is hosted, or any connected server, computer, system or database;
• attack the Site through a denial-of-service or distributed denial-of-service attack;
• use automated systems, scraping technologies or similar methods to extract substantial amounts of data or Content without prior written permission;
• interfere with or attempt to compromise the proper operation, integrity or security of the Site; or
• use the Site in any manner that infringes the rights of Turaco Hotels Corporation, a hotel company or any third party.

9. Disclaimer and Limitation of Liability

9.1 The Site and all Content made available through it are provided on an as-is and as-available basis, without any representation, warranty or guarantee of any kind, whether express or implied.

9.2 Turaco Hotels Corporation and each relevant hotel company exclude all representations, warranties, conditions and other terms, whether express or implied, that may apply to the Site, its Content, availability, operation or use.

9.3 Turaco Hotels Corporation, each relevant hotel company and their respective affiliates, officers, directors, employees, representatives and agents shall not be liable for any loss, damage, cost or expense arising out of or in connection with:

• access to, use of, or inability to access or use the Site;
• reliance upon information or Content displayed on the Site;
• any interruption, suspension, delay, error or unavailability of the Site;
• any inaccuracies, errors or omissions in Content displayed on the Site;
• any virus, malicious code, technological failure or other harmful material affecting a user’s device, software, data or other property in connection with use of the Site; or
• any third-party website, platform, service or content accessed through or linked from the Site.

9.4 To the fullest extent permitted by applicable law, Turaco Hotels Corporation and each relevant hotel company shall not be liable for any indirect, incidental, special, exemplary or consequential loss or damage, or for any loss of profits, revenue, sales, business, anticipated savings, opportunity, goodwill, reputation or data, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, and whether or not such loss was foreseeable.

9.5 Turaco Hotels Corporation and the relevant hotel companies do not warrant or guarantee that the Site will be continuously available, uninterrupted, secure, accurate, complete, current or free from errors, bugs, viruses or other harmful components.

9.6 You are responsible for taking appropriate precautions when accessing and using the Site, including maintaining suitable security and virus-protection software on your device.

9.7 This section relates to use of the Site and its Content. Accommodation, experiences, activities and other services booked or purchased through or in connection with the Site may be subject to separate terms, disclaimers, waivers and limitations of liability applicable to the relevant reservation, hotel company, service or third-party provider.

10. Third Party Services and Experiences

10.1 Certain services and experiences presented, recommended or arranged through our hotels may be provided wholly or partly by independent third-party providers, including transport providers, safari operators, guides, excursion providers and other service providers.

10.2 Third-party services may be subject to separate terms and conditions, availability requirements, safety requirements and cancellation policies.

10.3 Where reasonably necessary to fulfil a requested service, you may be required to enter into a separate agreement with the relevant third-party provider.

11. Privacy and Cookies

11.1 We respect your privacy and process personal information in accordance with the Turaco Collection Privacy Policy and applicable data-protection laws.

11.2 The Site may use cookies and similar technologies for essential functionality, analytics, personalisation and, where applicable and permitted, advertising.

14. Severability

14.1 If any provision or part of a provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision or part shall, to the extent required, be deemed deleted or modified to the minimum extent necessary.

14.2 The validity and enforceability of the remaining provisions will not be affected.

15. No Waiver

15.1 If Turaco Hotels Corporation or a relevant hotel company delays or fails to exercise any right or remedy available under these Terms or applicable law, this will not constitute a waiver of that or any other right or remedy.

16. Governing Law and Jurisdiction

16.1 These Terms and any dispute or claim, including non-contractual disputes or claims, arising out of or in connection with them, their subject matter or formation shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

16.2 Subject to any mandatory rights or protections available under applicable law, the courts of the United Republic of Tanzania shall have jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms.
